Skyvell privacy policy
1. responsible persons
The Skyvell website is operated by the Skyvell AG, Neubadstrasse 7, CH-4054 Basel, Switzerland, Basel-Stadt Commercial Register Office, UID: CHE-103.942.933
(hereinafter referred to as "Skyvell"). Skyvell is the controller within the meaning of the General Data Protection Regulation (GDPR) and the corresponding national legislation.
2. scope of the processing of personal data
Skyvell processes personal data of customers only to the extent necessary to provide a functional website and our content and services. The processing of personal data takes place regularly only with the consent of the customer. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law.
The customer's personal data will be deleted or blocked as soon as the purpose of storage no longer applies. Data may also be stored if there is a sufficient legal basis for doing so.
3. provision of the website and creation of log files
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer. The following data is collected:
- Information about the browser type and version used,
- The customer's operating system,
- The customer's Internet service provider,
- The IP address of the customer,
- Date and time of access,
- Websites from which the customer's system accesses our website,
- Websites that are accessed by the customer's system via our website.
The temporary storage of the IP address by the system is necessary to enable delivery of the Skyvell website to the customer's computer. For this purpose, the customer's IP address must remain stored for the duration of the session.
The data is deleted as soon as it is no longer required to fulfil the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.
4. rights of customers
4.1 Right to information
The customer may request confirmation from the controller as to whether personal data concerning him or her is being processed. If this is the case, the customer has a right to information about this personal data and the information in accordance with Art. 15 of the General Data Protection Regulation.
The customer has the right to request information as to whether the personal data in question is transferred to a third country or to an international organisation. Information provided by the customer when setting up a customer account is stored and processed in a central Skyvell database in Vienna/Austria.
4.2 Right of rectification
The customer has a right to rectification and/or completion vis-à-vis the controller if the processed personal data concerning him/her is incorrect or incomplete. The controller must make the correction without delay.
4.3 Right to cancellation
The customer may request the controller to erase personal data concerning him or her without undue delay and the controller is obliged to erase such data without undue delay where one of the following grounds applies:
(1) The personal data relating to the customer are no longer necessary for the purposes for which they were collected or otherwise processed.
(2) The customer withdraws their consent and there is no other legal basis for the processing.
(3) The personal data relating to the customer has been processed unlawfully.
(4) The deletion of the personal data concerned is necessary to fulfil a legal obligation to which the controller is subject.
4.4 Right to information
If the customer has asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerned have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. The customer has the right vis-à-vis the controller to be informed of these recipients.
4.5 Right to revoke the declaration of consent under data protection law
The customer has the right to revoke their declaration of consent under data protection law at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
5. access to data within the Group and from third parties
Skyvell may make the customer's personal data accessible to other companies of the Skyvell Group based within the EU and Switzerland if this is necessary for the execution of the purchases.
Skyvell may also make personal data available to third parties responsible for payment transactions and credit checks, and to external service providers such as website managers and designers, newsletter and e-mail delivery service providers, web hosting providers and web and e-mail agencies. These parties are appointed in writing as processors and are obliged to maintain strict confidentiality.
6. cookies
The Skyvell website uses so-called "cookies" in several places. Cookies are small text files that the visited website stores on the customer's end device and can be retrieved when the same website is visited again. Cookies are used to make the Skyvell website more user-friendly, to simplify its use and to make it more effective and secure. They are also used to analyse the use of the Skyvell website anonymously.
There are two different types of cookies - persistent and temporary cookies (session cookies). Persistent cookies are stored as a text file on your computer or mobile device. Session cookies are only stored temporarily and are automatically deleted when the browser window is closed.
In addition, the following categories of cookies can be distinguished, depending on the purpose pursued:
- Technical cookie (used exclusively for the transmission of a message in an electronic communications network or if this is absolutely necessary for the service of an information company that the customer has expressly requested)
- Profiling cookies (aim to create user profiles and are used to send the customer advertising based on their browsing behaviour). Skyvell does not use profiling cookies on the website.
- Analytics cookies (are used to statistically analyse the use of the website and monitor its functionality.
The third-party cookies used are not profiling cookies and are received from websites or web services other than the one visited by the customer. Skyvell uses third-party cookies to collect statistics using analytical tools in an anonymous and aggregated form. The cookies used by Skyvell are both persistent and temporary cookies.
Cookies do not contain viruses and do not cause any damage to your computer. The customer can easily remove cookies via the browser on their computer or mobile device.

The customer can also set their browser to warn them about cookies and then decide whether or not to accept them. It is also possible to set the browser so that it automatically rejects all cookies. In this case, certain interactive elements of the website cannot be used in part or in full.
